These Terms of Use (the “Terms”) constitute a legally binding agreement between any natural or legal person accessing or using the website, platform, tools, interfaces, and related services (collectively, the “Service”) and Innexo, having its registered office in Belgium (the “Operator”).
By accessing, browsing, or using the Service in any manner whatsoever, the user acknowledges having read, understood, and accepted these Terms without reservation. If the user does not accept these Terms in their entirety, the user must immediately cease any use of the Service.
The Service is made available exclusively as a beta version, for testing, evaluation, and experimental purposes. The user expressly acknowledges that the Service is not finalized, may contain defects, errors, bugs, or inconsistencies, and may evolve substantially or be withdrawn without prior notice.
The Service is provided solely as a technical tool facilitating the transmission of feedback or information and does not constitute a contractual, legal, commercial, or professional obligation to act upon such information. No guarantee is given as to the accuracy, completeness, reliability, relevance, or usefulness of any information made available through the Service.
The Operator reserves the unrestricted right to modify, suspend, limit, or permanently discontinue the Service, in whole or in part, at any time, without justification and without any obligation of compensation.
Access to the Service is limited to lawful use only. The user undertakes to use the Service in compliance with all applicable laws and regulations and in accordance with its intended purpose.
Any misuse, abuse, interference, circumvention of security mechanisms, unauthorized access, extraction of data, reverse engineering, or use of the Service for fraudulent, harmful, or unlawful purposes is strictly prohibited.
The Operator reserves the right, at its sole discretion, to restrict, suspend, or terminate access to the Service at any time, without prior notice, in the event of suspected non-compliance with these Terms or for any reason relating to security, legal risk, or operational integrity.
Where access to the Service requires the creation or use of credentials, the user remains solely responsible for the confidentiality and security of such credentials and for all actions carried out through their use.
The Operator shall not be held liable for any unauthorized access, misuse, loss of data, or damage resulting from the user’s failure to adequately secure their access information or systems.
The Service may allow users to submit information, messages, feedback, or other content (“User Content”). By submitting User Content, the user represents and warrants that such content is lawful, accurate, non-defamatory, and does not infringe the rights of any third party.
The user grants the Operator a non-exclusive, worldwide, royalty-free, transferable right to host, store, process, analyze, reproduce, display, and use the User Content for the purposes of operating, maintaining, evaluating, improving, and securing the Service.
The Operator does not verify, endorse, or assume responsibility for User Content and shall not be liable for its content, accuracy, or consequences. The Operator reserves the right, but not the obligation, to remove, modify, restrict, or retain any User Content at its sole discretion.
The user expressly acknowledges that the submission of feedback or information through the Service does not create any obligation for the Operator or any third party to respond, act, resolve, or remedy any issue.
The Service does not constitute a complaint handling mechanism within the meaning of consumer protection or hospitality regulations and does not replace any formal complaint or legal procedure.
All intellectual property rights relating to the Service, including but not limited to software, source code, architecture, databases, interfaces, visual elements, documentation, and branding, are and shall remain the exclusive property of the Operator.
No license or right is granted to the user other than the limited, non-transferable right to access and use the Service strictly in accordance with these Terms. Any reproduction, modification, extraction, or exploitation of the Service or its components without prior written consent is strictly prohibited.
The Service is provided on an “as is” and “as available” basis. The Operator makes no representation or warranty regarding availability, continuity, performance, uptime, data preservation, or error-free operation.
Temporary or permanent interruptions may occur, including for maintenance, updates, or technical reasons, without any obligation of prior notice or compensation.
To the maximum extent permitted by applicable Belgian and European law, the Operator shall not be liable for any direct or indirect damage, including but not limited to loss of profit, revenue, business opportunity, data, reputation, or goodwill, arising from or related to the use of or inability to use the Service.
This limitation applies regardless of the legal basis of the claim and includes damages resulting from errors, omissions, technical failures, downtime, data loss, reliance on User Content, or failure to transmit, process, or act upon information.
In any event, the total aggregate liability of the Operator shall be strictly limited to the amount paid by the user for access to the Service. During the beta phase, this amount is expressly agreed to be zero (0) euros.
The user agrees to indemnify, defend, and hold harmless the Operator against any claim, action, damage, loss, liability, or expense, including reasonable legal fees, arising from the user’s use of the Service, submitted User Content, breach of these Terms, or violation of applicable law or third-party rights.
Personal data is processed in accordance with the General Data Protection Regulation (EU) 2016/679 and applicable Belgian data protection laws. Further information is provided in the Privacy Policy, which forms an integral part of these Terms.
The Service may rely on third-party infrastructure or services. The Operator shall not be liable for failures, interruptions, or damages attributable to such third parties.
The user may cease using the Service at any time. The Operator may terminate or restrict access to the Service immediately and without notice.
Provisions relating to intellectual property, liability, indemnification, and governing law shall survive termination.
The Operator reserves the right to modify these Terms at any time. Continued use of the Service after publication of revised Terms constitutes acceptance thereof.
These Terms are governed exclusively by Belgian law. Any dispute arising out of or in connection with these Terms shall fall within the exclusive jurisdiction of the competent courts of Belgium, subject to mandatory provisions of European consumer law where applicable.
